Federal Courts Conflicting Ruling on Subsidies in Federal Exchanges

Yesterday’s court rulings in Virginia, which unanimously supported the intent of the law to allow Federal Subsidies for the state of Virginia, conflicted with the D.C. ruling which stated that only the States can decide on premium tax subsidies, makes for an interesting fall election. Are Federal Subsidies intended to help folks; a State decision or a Federal one? Without the subsidies, over 90% of the folks who enrolled in Obamacare would not have been able to purchase health insurance.

While many of you have called and emailed asking for my response, I would be completely flabbergasted if the D.C. appeal which will be heard by a panel of 11 judges instead of three, doesn’t agree with the Virginia decision.

However, I’ve been wrong many times with respect to Obamcare. Another example of a large piece of legislation that gets passed without folks actually reading the fine print.
